Professor Doctor Asem Khalil, Ph.D. in Constitutional and International Law, Associate Professor of Law of Birzeit University, West Bank, speaks of ways to consolidate the Palestine State, and definitely end Israeli crimes against humanity in the Palestinian territories.
Edu Montesanti: Dear Professor Doctor Asem Khalil, thank you so very much for granting this interview. How do you evaluate the meeting between President Donald Trump and Prime-Minister Benjamin Netanyahu on February 15? “I’m looking at two-State and one-state” formulations, President Trump said during a White House news conference with Mr. Netanyahu. “I like the one that both parties like. I’m very happy with the one that both parties like. I can live with either one”. Your view, please.
Dr. Asem Khalil: The Palestinians always called for a One State; as a compromise they accepted to enter a peace process where two state solution is envisaged as a way to get peace. If by one state, we mean equal rights for all citizens,
I don’t see why Palestinians would reject that – if they were first to ask for it and accepted only as a compromise the call for two state solution where most of historic Palestine will be part of the now state of Israel.
I think the answer given by Trump wasn’t thought through enough, and I don’t think Israel would go for a one State where one person one vote anyway.
Edu Montesanti: Why cannot Israel and the Palestinians decide alone the question? Why do Palestinians need a third party to get an agreement?
Dr. Asem Khalil: Palestinians are under occupation. It is not their own responsibility to negotiate with the occupier; for sure, it is not part of any negotiation whether to maintain or end occupation – negotiation may be on the modalities on how to do that only.
So far, Palestinians are in a weak position. They are requested to chose pacific means to reach liberation and end occupation, while at the same time, they are asked to negotiate directly with an occupier who continues to confiscate land day on day out.
It is the responsibility of the international community to put an end to one of the last occupations in the world. It is the responsibility of all community of states to make sure that rights of Palestinians – which are erga omnes – are respected.
Edu Montesanti: The United Nations Security Council Resolution 2334 voted on December 23 last year, condemning the Israeli settlements as a flagrant violation of international law and a major impediment to the achievement of a two-state solution, changes nothing on the ground between Israel and the Palestinians. UN member States “agree to accept and carry out the decisions of the Security Council”, according to the UN Charter. Human rights and the international community also condemns the Israeli settlements and military attacks against Palestinians. Journalist Daoud Kuttab observed in Al-Jazeera in February, in the article US and Israel join forces to bury Palestinian statehood: “Ever since the 1967 occupation, the United Nations Security Council has repeatedly expressed the illegality of the occupation, as in the preamble of Resolution 242 ‘emphasizing inadmissibility of the acquisition of territory by war’.” Why does nothing change year by year, massacre after massacre?
Dr. Asem Khalil: Change doesn’t come by UN resolutions. There are few cases like the one of Israel where the UN and the Security Council in particular showed how incompetent they are in dealing with Israel’s violations of Palestinians’ rights on their land and their right to self-determination.
Palestinian leadership, nonetheless, still think that such resolutions are important. They help maintain clear what is just and what is not.
What is acceptable and what is not. Changes in international relations and power relations between states may help in the future bring the change that is needed. Although it may be too late by then.
Edu Montesanti: What are the crimes committed by Israel against Palestinians?
Dr. Asem Khalil: There are various massacres that were committed by Israel against Palestinians surrounding the creation of the state of Israel in 1948 – causing and contributing to forced displacement and refugeehood of thousands of people.
Many other massacres were committed afterwards, either directly or indirectly. Bombings directed towards civilian areas and facilities continued in recent years when attacking Gaza.
Edu Montesanti: How is life in Gaza and in the West Bank?
Dr. Asem Khalil: Gaza is being qualified as a big prison – unqualified for human living because of lack of necessary civilian infrastructures and lack of jobs.
Most West Bank populated cities are living under Palestinian Authority rule – which coordinates with Israel in security and civil matters too.
Edu Montesanti: Professor Avi Shlaim observed days ago, in Al-Jazeera: “Sadly, the Palestinians are handicapped by weak leadership and by the internal rivalry between Fatah and Hamas.” Your view on the internal politics in Palestine, please, Professor Doctor Khalil.
Dr. Asem Khalil: He is right. This is part of the problem and why stagnation is in place. It is part of the story though.
The full picture is an Israeli occupation which separated Gaza from West Bank and maintained legal and political fragmentation since then; it is also in the way Oslo separated de facto the two areas and maintained a status quo where Palestinians are not dealt with by Israeli occupation – and contrary to the wordings of Oslo – as one political community and West Bank and Gaza Strip were not in reality considered or dealt with as one political entity.
Edu Montesanti: What could we expect from Arab leaders from now on?
Dr. Asem Khalil: We don’t have much expectations. We think the Arab region is now busy with their own problems.
They are now seeing the Palestinian issue as marginal and secondary. This is very problematic now.
Edu Montesanti: How do you see the Boycott, Divestment, Sanctions (BDS) movement?
Dr. Asem Khalil: The BDS movement can be the way ahead for peaceful resistance to occupation and apartheid in Palestine. Israel is aware of the historical precedence of South Africa and the boycott movement that ended up at the end in delegitimizing the apartheid regime in South Africa, and contributed to the entry of a new era there.
We hope similar thing happens now – not delegitimizing the state of Israel, but the apartheid regime in place.
Edu Montesanti: What is the solution to the conflict, Professor Doctor Asem Khalil?
Dr. Asem Khalil: There is no conflict. There is an occupation that needs to come to an end; a colonization project that needs to be aborted; an apartheid regime that needs to be dismantled; justice and equality to be restored.
If and when this is done, no need to think of mechanisms to end a conflict because it wouldn’t exist.

Much is being written regarding the Charlie Hebdo issue in Paris, France. I do not condone any killing but at the same time I do not support issues that violate human rights, religious freedom or freedom of speech and thoughts. Using cartoons to condemn Divine thoughts and beliefs is utterly wrong because they fall under hate crimes and not under freedom of speech as we are lied about. The perpetrators of hate continue to be protected. Islam is under attack and its adherents, the Muslims, are being targeted through provocation. In a recent article Charlie Hebdo and Tsarnaev’s trial: Cui ...
The Israeli historian Benny Morris has been very vocal of late in denying that Palestine was ethnically cleansed of Arabs in order for the “Jewish state” of Israel to be established. In a series of articles in the Israeli daily Haaretz, Morris has debated the question with several of his critics who contend that ethnic cleansing is precisely what occurred. Not so, argues Morris. So who’s right?
It’s worth noting at the outset that, while such a debate exists in the Israeli media, the US media remains, as ever, absolutely silent on the matter. Americans who get their information about the ...
1. Out of the 14.2 million Jewish people in the world, (in 2016), only a minority of 43% reside in Israel.
2. Whilst 75% of Israelis are Jewish, 21% are indigenous Arabs with restricted civil rights.
3. Israel has the highest birth rate in the developed world, with an average of 3 children per woman.
4. The Netanyahu government now receives more than US$6 billion every year from the US congress/ AIPAC lobby i.e. equating to $1000 annually for every Jewish Israeli, courtesy of the American taxpayer.
5. Israel has induced over 500,000 of its citizens to illegally settle in the Occupied Palestinian West ...
I was sickened to hear and watch the events occurring in France. Part of that was for the immediate families, friends and neighbors of those so needlessly killed. Another part was the fear factor, not fear of terror or for myself but fear for how the powers that be would ratchet up the security control within their own societies by using their own biased racist fear factors in order to rationalize it to control their own populations. A wider perspective is the sick feeling of realizing that humanity in general is capable of producing such atrocities.
The latter is where a ...
"Please don’t write about Ya’ir Golan!" a friend begged me, “Anything a leftist like you writes will only harm him!"
So I abstained for some weeks. But I can’t keep quiet any longer.
General Ya’ir Golan, the deputy Chief of Staff of the Israeli army, made a speech on Holocaust Memorial Day. Wearing his uniform, he read a prepared, well-considered text that triggered an uproar which has not yet died down.
Dozens of articles have been published in its wake, some condemning him, some lauding him. Seems that nobody could stay indifferent.
The main sentence was: "If there is something that frightens me about ...
On February 5, Military Times published a report stating that Washington has failed to publicly disclose potentially thousands of lethal airstrikes conducted over several years in Iraq, Syria and Afghanistan. The investigation reveals that in Afghanistan in 2016 alone, the U.S. air force carried out at least 456 bombings. The open-source report published by the Air Force Command doesn’t include these figures.
According to the Military Times, the information was obtained from “Congress, American allies, military analysts, academic researchers, the media and independent watchdog groups” and it shows that much of what the Pentagon has disclosed may be misleading or simply ...
The origin of jihadism is prohibited from being reported truthfully — this truth is prohibited by all of the Establishment ‘press,’ including almost all ‘alternative news’ sites — in the West, because it challenges all of the “sensitive” buttons (all of the bigotries, to put the matter in plain terms); and, though this fact (the Establishment’s bigotries, and its hypocrisy to preserve and protect their bigotries even while condemning those of other people) will prevent almost all of the news-media that I send this to from publishing it, nothing prevents me from writing it; so, here it is (in whatever ...

President Obama’s final foreign policy speech at MacDill air force base in Tampa, betrayed its purpose through the venue. The Tampa, Florida, base is home to Special Operations Command and Central Command — Special Operations playing an ever increasing role in counter terrorism.
The gist of the speech seemed to assert that the US is and should stay true to its values when fighting terrorism. An assertion when at the same time Congressman Ted Lieu, a California Democrat, has written a letter to Secretary John Kerry warning him the US could be charged with war crimes in aiding Saudi Arabia’s bombing ...
Several years ago two very distinguished American scholars wrote a book, The Israel Lobby.
The book made a very understated case that the Israel Lobby has far more power over the US government and media than is good for America or Israel, as it silences constructive critics who are Israel’s friends. The two scholars were demonized by the Israel Lobby as advocating the return of the Holocaust.
The Israel Lobby presented itself as just a poor little weak thing unable to stand up to all the Nazis assailing Israel. Meanwhile the US Congress was unanimously passing outrageous resolutions handed to it by ...

The role of Jewish figures and that of the State of Israel in the Ukrainian crisis has not gone unnoticed considering that this community represents less than 1 percent of the population. However, a secret report in the hands of the Netanyahu administration confirms that Ashkenazi Jews do not originate from the Levant, but are the descendants of the Khazars. This little-known population founded a Jewish empire in the tenth century on the banks of the Black Sea. Therefore, some Zionists see in Ukraine a possible second Israel.

The following document pertaining to the formation of “Greater Israel” constitutes the cornerstone of powerful Zionist factions within the current Netanyahu government (which has recently been re-elected), the Likud party, as well as within the Israeli military and intelligence establishment. The election was fought by Netanyahu on a political platform which denies Palestinian statehood.

The image of Srebrenica tells us more about the reality of the majority of the media and of course the “Muslim victim card” is being used in order to cleanse the Bosniak Muslims. After all, from enslaving Orthodox Christians during their brotherly love with the Turkish slave masters of the Ottoman Empire to having Muslim SS units who supported Adolf Hitler; then “victimhood” is needed in order to justify their history and culture.
Of course the wishy-washy brigade will tell us that the Ottoman period was enlightened and that the system of taking the eldest Christian boy (devshirme system) in the ...
‘If you buy fruit from Israel you deprive another human being of water and life’
Israel’s comparative economic success is essentially based on water stolen, since 1967, from Syria’s eastern shore of the Sea of Galilee – that provides Israel’s current primary source of fresh water. Rainwater from the Golan’s catchment area feeds into the River Jordan to provide about 30% of Israel’s current water supply.
Without this stolen water there would be no citrus fruit, melons, avocados or dates available for export under the label of ‘Produce of Israel’. And that is why the Netanyahu government is determined – with help ...

Israel is concealing vital records to prevent darkest periods in its history from coming to light, academics say
Al-Jazeera – 9 June 2016
Israel is locking away millions of official documents to prevent the darkest episodes in its history from coming to light, civil rights activists and academics have warned as the country’s state archives move online.
They claim government officials are concealing vital records needed for historical research, often in violation of Israeli law, in an effort to avoid damaging Israel’s image.

As news of appointments to the Trump administration flow in, the hard Right is riding high, and anti-Semitism and Zionism are in the news in ways that purveyors of conventional wisdom have to struggle to make sense of. The Trump phenomenon has undone conventional understandings of both.
Trump’s thirty-something son-in-law, Jared Kushner, Ivanka’s husband, embodies a lot of what has put those conventional understandings in doubt. A (modern) orthodox Jew and rabid Zionist, Kushner is not exactly éminence grise material; his is too young and insubstantial to be what Dick Cheney was for George Bush.
