Africa, Russia, United States Imperialism and the Bankruptcy of the International Criminal Court
The plight of the Palestinian people, subjected to nearly 70 years of Israeli occupation, has worsened while the imperialist governments have increased their funding, arming and diplomatic support for Tel Aviv. Gaza, popularly referred to as the largest open-air prison in the world, remains under de facto Israeli occupation along with other areas of Palestine and the Golan Heights in Syria [...]
As defections continue from the Rome Statute the Netherlands-based group says Washington may have engaged in torture
A recent article published in the New York Times appears to suggest that the United States will be investigated by the Netherlands-based International Criminal Court (ICC) for committing torture against captives in Afghanistan.
Surprisingly enough the ICC has almost exclusively focused its attention on alleged war crimes and acts of genocide taking place in Africa. Many of the cases have in effect served the interests of U.S. imperialism where governments which are targets for destabilization and regime-change are indicted by the prosecutorial institution in order to isolate their leaders by threating illegal arrests and seizures.
Somini Sengupta and Marlise Simons wrote in the report that: “The international prosecutor has been considering whether to begin a full-fledged investigation into potential war crimes in Afghanistan for years. In Monday’s (Nov. 14) announcement, the prosecutor, Fatou Bensouda, signaled that a full investigation was likely. Still, the prosecutor did not announce a final decision on an investigation, which would have to be approved by judges, and it is unlikely that the United States will cooperate. The United States is not a party to the court, which was established to prosecute war crimes, crimes against humanity and genocide. But Afghanistan is a member of the court, so allegations of crimes committed in its territory, no matter the nationality of the perpetrators, are widely considered to be fair game.”
Even though Washington was initially a signatory to the Rome Statute under the presidency of Bill Clinton in 2000, it has never been ratified by the U.S. Congress. The Rome Statute set the stage for the creation of the ICC which the administrations of George W. Bush, Jr. and Barack Obama have refused to recognize as a body which its citizens are subject to honor.
Although the Rome Statute was adopted in 1998 and went into effect some five years later, successive U.S. administrations have sought to use this legal body most notably against the Republic of Sudan headed by President Omar Hassan al-Bashir and the Libyan Jamahiriya formerly led by the slain Col. Muammar Gaddafi. Cases have also been brought against the government of the Republic of Kenya under President Uhuru Kenyatta and Vice-President William Ruto.
For years these leaders accused of gross human rights violations, crimes against humanity and even genocide have been subjected to corporate and governmental media campaigns aimed at undermining their legitimacy both domestically and internationally. Nonetheless, the historical genocidal measures enacted by the U.S., Britain, France, Portugal, Spain, Germany and even the Netherlands itself have never been examined.
The crimes of forced removal of indigenous people, the enslavement of millions and the systematic mass extermination of untold numbers on all populated continents over the last five to six centuries are never acknowledged by the ICC or similar entities. Consequently, the ICC is considered biased by many African states and regional institutions.
During the Jubilee celebrations of the formation of the Organization of African Unity (OAU) sponsored by the successor African Union (AU) in Addis Ababa, Ethiopia held discussions in May 2013 on the withdrawal from the ICC. Routinely the European Union (EU) and the U.S. bypasses the AU in violation of diplomatic protocol in order to hold summits that exclude key African states.
States such as Zimbabwe, Sudan, and Eritrea among others are not invited to these gathering in Brussels and Washington. Other African governments have refused to attend in light of these neo-colonial efforts by European and North American states aimed at creating divisions among members of these regional blocs.
In recent weeks the Republic of South Africa, Burundi and Gambia announced that their governments would no longer recognize the Rome Statute. These developments portends that other states will soon follow suit.
Even according to Newsweek magazine, “In what seems to be a continental domino effect, three African states have publicly declared their intended withdrawal from the International Criminal Court (ICC) over the past month. The court has repeatedly been criticized by African states as an inefficient, neo-colonial institution of the Western powers to try African countries.
This argument is supported by the fact that nine of the ten situations under investigation, with three others under preliminary investigations, involve African countries.”
Other African states which could soon withdraw include the Republic of Namibia, Kenya and Uganda. These are major countries on the continent and their rejection of the Rome Statute and the ICC would be a major blow to this institution.
Russia Announces Refusal to Ratify
On November 16, the Russian-based news agency Tass wrote that Moscow had no intentions of ratifying the Rome Statute which ostensibly guides the operations of the ICC. The announcement was made by the offices of President Vladimir Putin and posted on governmental web site the following day.
The resolution mandates that notice to this effect will be given by the Russian Foreign Ministry to the United Nations Secretary General. The Rome Statute was developed with Moscow’s involvement and later adopted by the UN Diplomatic Conference of Plenipotentiaries. Russia reportedly signed the document on September 13, 2000. However, it was never fully adopted by any government in Russia over the last sixteen years.
This announcement is likely related to a report issued by the ICC on its investigation into what the Netherlands-based group says is Russian annexation of Crimea in 2014 and the continuing war engendered by U.S. intervention into the internal affairs of Ukraine. In February 2014, the elected government of Ukraine was overthrown with the support of the administration of President Barack Obama which funded campaigns that supported fascist organizations to serve as the main force in the removal of former President Viktor Yanukovych.
Kiev’s new U.S.-backed regime was so anti-Russian that the people of Crimea voted overwhelmingly to rejoin the Russian Federation. During the decades-long existence of the Union of Soviet Socialist Republics (USSR), the Crimean Oblast was legally a subdivision of the Russian Soviet Federative Socialist Republic. In 1954, a transfer of Crimea into the Ukrainian Soviet Socialist Republic took place.
With the collapse of the USSR in 1991, Crimea then was ceded to a putative independent Ukraine. Later that year Crimea had re-gained its autonomy following a national referendum.
The following year in 1992, the Ukrainian parliament abrogated the Crimean Constitution and in 1995, the office of President. By 1998, Crimea had a new constitution imposed upon the state that mandated less autonomy. Therefore, any legislation adopted by the Crimean parliament could be overturned by an act of the Ukrainian parliament.
Imperialists War Crimes Should be Investigated and Prosecuted
Just over the last decade-and-a-half, the U.S., Britain, France and other imperialist states have committed horrendous war crimes in Afghanistan, Iraq, Haiti, Libya, Syria, Yemen, Sudan and other geo-political regions. These crimes are related to the intervention and occupations of nation-states based on false pretenses designed to eliminate independent governments and the seizure of their resources.
As a direct result of these massive bombings, invasions, occupations and partitions, tens of millions of people have been displaced, impoverished and disenfranchised. Millions have died in combined military actions against Afghanistan, Iraq, Haiti, Libya, Syria and other countries.
The plight of the Palestinian people, subjected to nearly 70 years of Israeli occupation, has worsened while the imperialist governments have increased their funding, arming and diplomatic support for Tel Aviv. Gaza, popularly referred to as the largest open-air prison in the world, remains under de facto Israeli occupation along with other areas of Palestine and the Golan Heights in Syria.
At some point these crimes must be legally addressed along with the development of the Atlantic Slave Trade, colonialism, neo-colonialism and the denial of full participation in the UN and other international bodies by the imperialist governments. The abolition of the effectiveness of the ICC should pave the way for a broader discussion on the creation of a genuine world body to pursue war crimes and the violations of the fundamental human rights of the majority of the world’s population.

GR Editor’s NoteMoscow is accused of doping as part of a US dirty tricks campaign to prevent Russia from participating in the 2016 Summer Olympics in Rio de Janeiro. What is the record of the US with regard to doping? The main sports organizations including the NFL, MLB, and NBA have allowed unusually relaxed policies for performance-enhancing drug testing and punishment. The USADA is the US government agency responsible for the implementation in the United States of the World Anti-Doping Code, Yet, the record suggests that the USDA does not actively intervene in “big money sports” and often turns a blind eye ...

Foreign Minister Sergey Lavrov is calling for an “impartial investigation” into grisly reports by a European investigative commission alleging that Kosovo government officials were involved in the trade of human organs. In an exhaustive report released by the Parliamentary Assembly of the Council of Europe (PACE) in December, it was alleged that Serbian detainees of the Kosovo Liberation Army (KLA) were kidnapped and murdered by Kosovo Albanians so their organs could be sold on the black market. The report says the crimes occurred after the Kosovo War ended in 1999.These shocking allegations came on the heels of a two-year investigation into a ...
Today marks twenty-nine years since the shootdown by the USS Vincennes of Iran Air flight 655, which killed all of the plane’s 290 civilian passengers. This shootdown of a civilian airliner by a US naval ship occurred on July 3, 1988, toward the end of the eight-year Iran-Iraq War.This incident is, of course, something that the people of Iran well remember. Americans who rely on the US mainstream media, on the other hand, would have to be forgiven for never having heard about it.Furthermore, in the rare instances when the media do mention it, to this day they tend to ...

All of the Balkans, legendary German Reichskanzler (Imperial Chancellor) Otto von Bismarck famously said, were not worth the bones of a single Pomeranian grenadier. And Bismarck, a Prussian landowner or junker had nothing but amused contempt for Pomeranian grenadiers who were regarded as a standing joke in the German Army.In 1890, brash, young new German Emperor Wilhelm II fired Bismarck after 28 years as minister-president of Prussia and then first Imperial Chancellor of Germany. He abandoned the priority policy of maintaining warm ties and close communications with Russia that Bismarck had always followed and scrapped the Dreikaiserbund, the League of ...
Azeris may celebrate November 10 as the date of their victory over Armenia in the 2020 Nagorno Karabakh War but, when the heady days of celebration recede, they may just realize it marks the beginning of the end to true Azeri independence. When Armenian prime minister Nikol Pashinyan accepted a ceasefire on Nov. 10, 2020, Azerbaijan President Ilham Aliyev had reason to feel triumphant. He reversed the territorial losses suffered by his father, Azerbaijan’s former president, at the end of the first Nagorno Karabakh War. He had successfully fooled the United States by committing to diplomacy in exchange for cash and ...
Ema Miljkovic-Bojanic, M. A.Institute of History ofSerbian Academy of Sciences and ArtsBelgrade, 2000Malcolm’s Apology of the “Pax Ottomana” (Ab)using of historiography and historical facts for political ends is not a novelty introduced towards the end of the twentieth century. Its instances have been known throughout history, so that “practically there is not a single epoch of human history that was not controlled – by the Church, state, nation, party, leadership…” But precisely at a time when historiography seemed to be getting rid, at least partly, of the grip of “supervision” and when a critical approach was getting the upper hand, the ...
The Western-backed myth of a Greater SerbiaMuch space, time and efforts have been devoted in the recent history of West Balkans, and in particular in the latest political upheavals, about the alleged project of a Greater Serbia especially by the Western authors either academic scholars or journalists.[1] The issue must be, however, considered together with its counterparts from Croatia (a Greater Croatia) and Albania (a Greater Albania). There are two focal questions that arose here:Were all these projects serious and what was the origin of this maximalist concept of forming the national states in the otherwise ethnically mixed area?Whose exact ...
President Obama is still considering arming Ukraine in case the latest ceasefire is breached and the conflict escalates; but political analyst Stephen Lendman told Sputnik in an exclusive interview that the US leader is lying, and that the US has been supplying arms to Kiev from the very start of the military operation. The ceasefire between Kiev forces and independence supporters of Donetsk and Luhansk is generally holding, shelling in Donbas has stopped as the truce came in force on midnight, a spokesperson at the Kiev special operations headquarters said Sunday. But a day earlier Ukrainian President Petro Poroshenko and US ...
Caroline Elkins’ accounts of British soldiers ramming broken bottles into the vaginas of female Kenyan prisoners during the Kikuyus’ Mau Mau revolt is not, by any stretch, the worst example of Albion’s imperial violence she recounts. Because this 870 page book is awash with similar instances of systematic war crimes by the British administration in Kenya, in Nigeria, Jamaica, South Africa, Malaya, Palestine, Cyprus, Nyasaland, India and countless other outposts of empire, justifiable comparisons between the British and the Nazis arise time and again. And, although many Nazis were brought to book for their crimes, no British were, even though General ...
The measures being taken by the government of President François Hollande in response to Friday’s terrorist attacks in Paris constitute an unprecedented attack on democratic rights. The Socialist Party (PS) government has declared a state of emergency and mobilized more than 100,000 security personnel throughout the country, including regular police, gendarmes, paramilitary riot police and military forces. It is impossible to walk the streets of any major city without running into individuals decked out in camouflage or dressed in black, toting automatic rifles. These paramilitary forces have been given the power to raid any home and arrest or kill anyone declared ...
Maybe it is the best agreement ever signed… Maybe by applying it, Greece and the Former Yugoslav Republic of Macedonia, will enter an era of great friendship and enormous prosperity…Maybe… The only small detail is the majority of the deputies of the Greek Parliament do not know the agreement is so good. Their parties declared they are opposing the agreement and they won’t ratify it. Even the An.Ell. party, which is the junior partner of SYRIZA in the government, does not know how profitable is this agreement. They said they would vote No to the agreement when introduced in the ...
“Now that the global circumstances have changed, and when the United States and NATO are losing their influence, and while the powers that are in favor of preserving Kosovo and Metohija – such as Russia and China – are strengthening, we are nevertheless pursuing a policy of complete surrender.”The aim of the internal dialogue conducted by the Serbian President Aleksandar Vucic, should be to distribute responsibilities and to be the cover for the final surrender of Kosovo and Metohija. The government constantly assures us that it will never recognize Kosovo as an independent State, but here we must point out the ...
PrefaceThe “Macedonian Question” is today actual for several reasons of whom two are of the fundamental importance: 1. The Albanian secession in the FYROM; and 2. The Greek dispute with the FYROM authorities over several issues.[1] For the matter of illustration, for instance, Greece is so far blocking Macedonia’s joining NATO and the EU because of an on-going dispute between the FYROM and Greece. The main disputable issue is the title of “Macedonia” used in the country’s Constitution in the form of the official state-name as the Republic of Macedonia.[2] When the ex-Yugoslav Socialist Republic of Macedonia voted for independence ...
Amid a divisive debate in Ukraine on state honors for nationalists viewed as responsible for anti-Semitic pogroms, the country for the first time observed a minute of silence in memory of Symon Petliura, a 1920s statesman blamed for the murder of 50,000 Jewish compatriots. The minute was observed on May 25, the 90th anniversary of Petliura’s assassination in Paris. National television channels interrupted their programs and broadcast the image of a burning candle for 60 seconds, Ukraine’s Federal News Agency reported.A French court acquitted Sholom Schwartzbard, a Russia-born Jew, of the murder even though he admitted to it after the court ...
One of the West’s top points in condemning Vladimir Putin’s “regime” since 2007 has been his alleged suppression of democratic institutions, including an assault on media freedom and imposition of government-directed propaganda. This week, the accusation was repeated in a resolution of the European Parliament calling for stronger counter-measures in defense of European values against “information warfare” from Moscow. The charges — that Russian media are only an instrument of state propaganda directed at the domestic population to keep Russian citizens in line and at foreign audiences to sow dissent among Russia’s neighbors and within the European Union — are taken ...
For decades former Nazis and German war criminals served at the highest echelons of NATO.Most of them were highly decorated Nazis, who later served in top positions in the Western German army, and were later promoted to serve as Commander and Chief of all NATO forces in Europe. This was not a unique event, but a very common phenomenon in post-WW2 Western Europe and especially in Western Germany.Nazi war criminals and people who supported and helped Hitler to carry out the holocaust and other war crimes, genocides, and crimes against Humanity were almost never put on trial for their crimes against ...
King Abdullah is being eulogized in the most unrealistic ways possible, from CNN designating him as a “reformer” to Chuck Hagel calling him “a powerful voice for tolerance, moderation and peace — in the Islamic world and across the globe.” Israeli President Reuven Rivlin takes the cake, however, by proclaiming that “his smart policy contributed greatly to Middle East stability.” None of these characterizations are true in any way, as Abdullah’s main legacy isn’t one of reform, tolerance, and regional stability, but of destruction, hate, and regional instability. Every contemporary Mideast problem except for the Israel-Palestine issue can be directly ...
So the moment we’ve been holding our breaths for a week finally came. In the end, I am mighty glad that this particular strike seems more like the impotent thrashing of the neocon snake that didn’t dare to attack places where Russian servicemen were likely to be killed, than it does the start of World War III. For the moment, at least, thank God.But the fact that it was a fairly limited strike — compared to what it might have been — in which the majority of missiles failed to hit their targets, having been eliminated by Soviet-era air defences, ...
