Corpus Delicti: How the Western Mainstream Propaganda Lies on Bosnian War (1992-1995)

Hits: 1554

Bosnian Muslim Kasim Blekic was allegedly murdered by Bosnian Serbs but was, in fact, alive outside of Sarajevo.

One of the fundamental legal principles or concepts of jurisprudence is that before a person can be charged with a crime, evidence must be shown that a crime has occurred. This is known by the legal principle of “corpus delicti”, the body of a crime, meaning that there must be evidence that a crime has occurred before a defendant can be charged or prosecuted for the crime. The 6th edition of Black’s Law Dictionary (1990) gives the meaning of corpus delicti as “the fact of a crime having been actually committed”. In a murder or homicide case, evidence must be presented that meets the beyond a reasonable doubt standard. In  murder cases, evidence must show that the specific injury has occurred, a human being has died, and that the injury can be ascribed to criminal agency on the part of an individual as the cause of the injury, that the victim died due to a criminal act.

Bosnian Serb Borislav Herak was born in Sarajevo and lived and worked in the capital city of Bosnia-Hercegovina but was referred to as a “Serb” by the U.S. and Western media, and by his Bosnian Muslim captors, stripping him of his Bosnian and Sarajevo identity, implying he was from Serbia.

The concept of corpus delicti is essential and elemental in all murder or homicide cases. It is the bedrock upon which the crime of murder is prosecuted in Anglo-American jurisprudence. During the Bosnian civil rar of 1992-1995, this fundamental legal precept was blatantly and flagrantly violated. The most egregious case is that of the prosecution of Bosnian Serbs Borislav Herak and Sretko Damjanovic. In March, 1993 they were tried, and subsequently convicted of committing war crimes by the Bosnian Muslim faction and sentenced to death. Herak, who had been born on January 18, 1971 in Sarajevo and who had worked as a store clerk, was charged with raping 16 Bosnian Muslim women and murdering 32 Bosnian Muslim POWs and civilians, although the figures were repeatedly altered. After their conviction, two of their alleged victims, Kasim and Asim Blekic, were found alive.

Bosnian Serb Borislav Herak was put in a 6-by-12 foot cell, after he was beaten and his head was shaved by his Bosnian Muslim guards.

In the January 31, 1996 New York Times story “Symbol of Inhumanity in Bosnia Now Says ‘Not Me’”, Kit R. Roane admitted that there was no corpus delicti, no evidence of any crimes, murders or rapes: “The Bosnian Government has no witnesses to the killings and has recovered no bodies.” The Houston Chronicle reported similarly that there was no evidence of any crimes: “There are no witnesses to the killings Herak is said to have committed and no bodies of those thought dead have been recovered.”

Bosnian Serbs Borislav Herak and Sretko Damjanovic were tried, convicted, and sentenced to death by execution by firing squad based on the absence of a corpus delicti, based on the lack of any evidence. How is this justice? Why was the Bosnian Muslin faction allowed to stage this travesty of justice?

This egregious perversion of justice was sponsored and endorsed by the U.S. government and the U.S. media. John F. Burns even received the Pulitzer Prize in 1993 for his “interviews” of Borislav Herak. Herak and Damjanovic later recanted their “confessions” which were obtained through torture. Damjanovic displayed four knife wounds and a broken rib. The Bosnian Muslim interrogators and guards had beaten, tortured, and abused him to obtain a false confession.

John F. Burns won a Pulitzer Prize for reporting that was based on lies and deceptions in 1993

On March 1, 1997, John F. Burns’ newspaper, The New York Times, in a story by Chris Hedges revealed that the two Bosnian Muslim murder victims were actually alive. In the story, “Jailed Serbs’ ‘Victims’ Found Alive, Embarrassing Bosnia”, the New York Times disclosed that the alleged murder victims had been members of the Bosnian Muslim Army during the civil war who still lived in Sarajevo. Kasim Blekic was photographed raising sheep outside of Sarajevo.

This horrendous miscarriage and travesty of justice has not, however, received the attention and analysis it deserves. Moreover, Burns was never stripped of his Pulitzer Prize for fraudulent and fake reporting. Ironically, the prize was named for Joseph Pulitzer, who was, along with William Randolph Hearst, one of the founders of yellow journalism, a deceptive, sensationalist, and distorted form of journalism that is more akin to propaganda or public relations than to news reporting.

12 Signs America is on the Decline
When it comes to a few key indicators, Ireland, the UK, Canada and even Albania and Greece are surpassing America. America is declining, in large and important measures, yet policymakers aren’t paying attention. So argues a new academic paper, pulling together previously published data. Consider this: America’s child poverty levels are worse than in any developed country anywhere, including Greece, devastated by a euro crisis, and eastern European nations such as Poland, Lithuania and Estonia. Median adult wealth in the US ($39,000) is 27th globally, putting it behind Cyprus, Taiwan, and Ireland. Even when “life satisfaction” is measured, America ranks #12, behind ...

German Interests in the War Against Yugoslavia
Churchill once said that in war the truth is so precious it has to be surrounded with a bodyguard of lies. In Germany over the last two months one clearly saw the fabrication of such a bodyguard. Even as air attacks proceeded against civilian targets—destroying factories, electricity works, refineries, bridges, streets, railway lines and apartment blocks— German government representatives spoke of a ” humanitarian action ” . Despite the fact that the NATO attacks unleashed the massive wave of refugees and reduced towns and villages in Kosovo to ruins , it has been maintained to the very end that the aim ...

The Psychology of Fascism
Some recent studies have reminded us of the characteristics of fascist movements and individuals, particularly as they manifest among politically active fascists. For example, in his recent book How Fascism Works: The Politics of Us And Them Professor Jason Stanley has identified ten characteristics shared by fascists which have been simply presented in the article ‘Prof Sees Fascism Creeping In U.S.’These characteristics, readily evident in the USA, Europe, Israel, Saudi Arabia, Myanmar and elsewhere today, include belief in a mythic (false) past, propaganda to divert attention and blame from the true source of corruption, anti-intellectualism and a belief in the ...

Mainstream Media: Fake News Through Lying by Omission
Fake news is simply a new, Trump-popularized descriptive for media lying that occurs in 2 basic forms, lying by omission and lying by commission. Lying by omission is far, far worse than lying by commission because the latter can at least admit refutation and public debate. Western Mainstream media impose a huge burden of fake news on Western societies through entrenched and pervasive lying by omission. Indeed the most egregious and pervasive Mainstream media lie of omission is suppression of reportage of such lying by omission. The unimpeded, remorseless, corporate-dominated Mainstream media, politicians and pliant intellectuals are now going further, and ...

Croatia and Nazi Germany
While this excellent analysis by Srdja Trifkovic focuses on the “internal” history of Croatia, it is important to note that four days after Nazi Germany declared war on the United States, Hitler’s staunch ally the Independent State of Croatia (NDH) declared war on both the United Kingdom and on the United States on December 14, 1941. What makes this especially significant is that less than three years later, on April 16, 1944, which was Easter Sunday for the Serbian Orthodox, the Anglo-American forces bombed Belgrade, the capital of their loyal and devoted ally Serbia, even though there was no strategic ...

What America’s Aristocracy Want
The American aristocracy want inequality of rights, with two basic polar-opposite classes: the ‘elite’, with themselves at the top of everything, and everybody else below them, as subjects to be ruled by them, in such ways as they (themselves, and their fellow ‘elite’) can agree to do. They are convinced that they have earned their high status, in one way or another, and they compete ferociously amongst themselves, to rise even higher within the aristocracy. Many of the aristocrats think that they are ‘elite’ because they are the richest; many think instead that the ‘elite’ are the smartest or the most ...

Never mind the slow but steady dismantling in the fabled West of the “welfare state”, that temporary horror the elites grudgingly used to tolerate. But that was only as a means of pacifying their subjects and winning over credulous hearts and minds in the competing socialist camp, while it still existed. To be fair, concern for public wellbeing never was an ideological item in the Western “value” system to begin with. It was dissimulated for a while merely as a tactical measure to confuse the masses. But one assumes that at least the various personal “freedoms” that Western countries used ...

Obama and Clinton Co-Founders of ISIS?
On 10 August 2016, Republican presidential candidate Donald Trump accused president Barak Hussein Obama and Democrat presidential candidate Hillary Clinton of co-founding the jihadist rebel organization ISIS (Islamic State) operating mainly in Syria and Iraq but with operative in many Middle Eastern countries and around the world. Trump used Obama’s full name to provoke a racist-xenophobic response from the public about the Arabic-sounding name rooted in East Africa. Immediately, critics insisted that Trump made outrageous and ignorant comments about complex foreign affairs matters he does not fully comprehend. The following day Trump clarified that he meant exactly what he said and ...

Another Dangerous Rush to Judgment in Syria
Exclusive: The U.S. government and the mainstream media rushed to judgment again, blaming the Syrian government for a new poison-gas attack and ignoring other possibilities, reports Robert Parry. With the latest hasty judgment about Tuesday’s poison-gas deaths in a rebel-held area of northern Syria, the mainstream U.S. news media once more reveals itself to be a threat to responsible journalism and to the future of humanity. Again, we see the troubling pattern of verdict first, investigation later, even when that behavior can lead to a dangerous war escalation and many more deaths. Before a careful evaluation of the evidence about Tuesday’s tragedy ...
